Rejection of application by the IIPO

According to patent & trademark law of Iran, a trademark application will go through formal examination and if an application has been rejected the applicant has the following rights:

1. If an application has been rejected, the applicant has ten (10) days to file a petition before the court against the IIPO’s decision for rejection of the application.  The time frame of 10 days is calculated from the date that the notice of rejection has been served to the agent.

2. It is possible to provide the IIPO with letter of consent if one can be obtained from trademark owner of cited mark.  The letter of consent should be certified and legalized by the Iranian consulate.
