Cancellation of trademark

According to patent & trademark law of Iran, if no objection is raised against the registration of a trademark within three (3) years from registration date, no objection will be considered afterwards unless:

1. If it is proved that the defendant was aware on the course of registration that the trademark had been continuously used by the plaintiff. However if the defendant proves that the plaintiff was aware of the trademark registration during the three (3) years from the registration date, the objection will be rejected.
